Ban & Fine For Chelsea Transfer Breach
On 3rd Sep, Fifa has reach a decision on issuing ban and fine on both Chelsea and the player Gael Kakuta. After their last meeting on the 28th Aug 09, Dispute Resolution Chamber (DRC) has decided to charge Chelsea for breaking Fifa’s regulations on the status and transfer of players state in Article 17, paragraph 4
“It shall be presumed, unless established to the contrary, that any club signing a professional who has terminated his contract without just cause has induced that professional to commit a breach. The club shall be banned from registering any new players, either nationally or internationally, for two registration periods.”
Chelsea has been handed a transfer ban from any signings for the entirety of 2010 until Jan 2011 by Fifa as they found guilty of inducing Gael Kakuta to breach his contract with Lens in 2007. Kakuta was fined €780k for breach of contract and banned from playing for the next four months. A further of €130k compensation is to be pay by Chelsea as Lens training fee.
Chelsea is set to appeal with all their capability, to life the 18 months transfer ban. Chelsea has an average age of 28.9 from their starting 11 lineup, 2nd oldest among all the EPL club. Althought Chelsea has spent less than £20million this summer, but they will need to rely of fresh blood or new player to reinforce the team to up the pace and stamina for their solid football in the next 2 years.
A similar situation is going to be happen with Man Utd soon, as Le Havre are going to submit a complain about Man Utd way of signing Paul Pogba over to Old Trafford. For these club, they spend millions on their academy system yearly, not to let their talented gradulate joining some other club in the end. Fifa might set some new rule to protect the academy system of small club.
